1. Purpose

This Legal Notice regulates the use of the ADALVO web site (“Web Site”), which is accessed through the URL https://www.adalvo.com/.

The use of the Web Site attributes the condition of “User” to any person who interacts within the Web Site, implying acceptance of all conditions included in this Legal Notice. Specific aspects of the Web Site, due to their speciality, may be subject to conditions or rules that may replace, complete, or modify this Legal Notice, which therefore must also be accepted by the User.

ADALVO reserves the right to modify this Legal Notice at any time and without prior notice.

2. Intellectual and Industrial Property

All contents of this Web Site as well any industrial or intellectual property rights or any other right related to the Web Site belong to ADALVO and/or third parties (“IP”) and the User acknowledges it does not acquire any rights over such IP by the use of this Web Site.

In relation to the Web Site, the User shall:

  1. Refrain from using any content thereof for commercial, distribution, modification, or alteration purposes;
  2. Refrain from reproducing or copying for private use any software or databases;
  3. Refrain from extracting or reusing all or a substantial part of the contents; and
  4. Refrain from removing or manipulating the copyright indications or other credits that identify the holder of rights of the contents, as well as the technical protection devices, digital fingerprints, or any protection mechanism or information incorporated to the contents.

ADALVO does not grant any license or authorization of use of any of ADALVO’s IP to the User.

If the User becomes aware of the existence of any illicit or illegal content, or content that could imply an infringement of intellectual and/or industrial property rights, the User must immediately notify ADALVO through the e-mail address alwaysontarget@adalvo.com so that it can proceed to the adoption of the appropriate measures.

3. Rules of use of the Web Site

The User shall not access the Web Site for illicit or unauthorized purposes. In particular, but not exclusively, it is forbidden for the User to:

  • Use the content of the Web Site for purposes contrary to law, good faith, morality, and public order;
  • Use the Web Site in a way that may cause damage or alterations in the operation of ADALVO's or third parties' equipment and servers;
  • Use the Web Site to install or transfer any virus or other harmful programs; and
  • Breach, or attempt to breach, the security or authentication measures of the Web Site or any network connected to the Web Site, or the security or protection measures inherent in the content offered on the Web Site.

The breach of any of the above obligations by the User may lead to the adoption by ADALVO of appropriate measures protected by law and in the exercise of its rights or obligations, without the possibility of any compensation for damages caused.

If the User finds any information or content on the Web Site that may be inappropriate, contrary to current regulations, or contrary to the conditions set out on the Web Site, the User shall immediately inform ADALVO through the e-mail address alwaysontarget@adalvo.com so that it can proceed to the adoption of the appropriate measures.

The User is responsible that the information provided to ADALVO through this Website is true. The User is responsible for the accuracy of all of the data that the User provide to ADALVO through the Web Site, as well as for keeping such data up to date in such a way that it corresponds to his/her real situation. The User will be responsible for any false or inaccurate information provided to ADALVO through the Web Site and for any damages caused to ADALVO or third parties.

4. Links to ADALVO's channel on other platforms and social networks

ADALVO makes different linking tools available to Users that visit the Web Site which allow the Users to access channels and pages of the Web Site that ADALVO maintains on different platforms and social networks belonging to and/or managed by third parties (“Linked Platform”).

There is no relationship between ADALVO and the owner, manufacturer, or distributor of the Linked Platform. No acceptance or approval has been made by ADALVO of the contents and/or services provided within the Linked Platform, being the owner, manufacturer, or distributor of such Linked Platform solely responsible for such contents and/or services.

In the event Adalvo were to share any private information about its Users with a Linked Platform, the purpose of such disclosure shall only be the one established within this Legal Notice/General Conditions of Us, as well as within the Privacy Policy of the Web Site.

Any information that the User wishes to provide to a Linked Platform will be under his/her own responsibility.

The activation and use of these tools may require the identification and authentication of the User (login/password) on the corresponding Linking Platform, which is completely external to ADALVO’s Web Site and beyond the control of ADALVO. By accessing such Linked Platforms, the User accesses an environment not controlled by ADALVO and ADALVO assumes no responsibility for the security settings of such Linked Platforms.

The User acknowledges and agrees that ADALVO shall not assume responsibility for the content and/or services accessed by the User on the Linked Platforms, or for any content, products, services, advertising, or other material available on such sites.

5. Data Protection

In accordance with the provisions of the current regulations on Data Protection, all personal data provided during the use of the Web Site will be treated in accordance with the provisions of the Privacy Policy that all Users must expressly accept to use the Web Site.

6. Applicable Legislation and Jurisdiction

This Legal Notice is governed entirely by the law of the Republic of Malta (“Law”). The User agrees to make correct use of this Web Site in accordance with the Law, with this Legal Notice, as well as with the other conditions, regulations and instructions that may be applicable. If you are a consumer and habitually reside in a Member State of the European Union, the laws of that Member State will apply to any claim, cause of action or dispute that arises out of or relates to this Web Site, and you may resolve your claim in any competent court in that Member State that has jurisdiction over the claim. In all other cases, for any litigious matter derived from or related to this Web Site, the Malta legislation in force at the time of the litigation will be applicable, and Adalvo will submit to the Courts and Tribunals of Malta, as well as, if applicable, to the Consumer Arbitration Courts or similar to which Adalvo is adhered at the time of the dispute. 

The User shall be liable to ADALVO and third parties for any damages that may be caused by breach of these obligations.
